These Terms & Conditions govern the use of the Mocka3D mobile application (the "App"). By downloading, accessing or using the App, you agree to be bound by these terms. If you do not agree with them, you must refrain from using the App.
Using Mocka3D implies full acceptance of these Terms & Conditions. If you are a minor, you represent that you have the consent of a parent or legal guardian to use the App.
Mocka3D reserves the right to modify these terms at any time. Continued use of the App after changes are published constitutes acceptance of those changes.
Mocka3D is a 3D mockup generation tool for sublimation products. It lets you upload your own designs, preview them on photorealistic 3D models (mugs, magic mugs, tumblers, notebooks and bottles, among others), export images and videos, and share preview links.
The App is offered both as a free version and as a paid subscription, "Mocka3D Pro", with additional features.
Creating an account is optional: the App can be used anonymously. If you choose to register via email or a third-party provider, you are responsible for keeping your credentials confidential and for all activity carried out from your account.
You agree to provide accurate and up-to-date information when registering.
You retain full ownership rights over the images, designs and other material you upload to the App ("User Content").
By uploading User Content, you grant Mocka3D a limited, non-exclusive and revocable license to store, process and display that content for the sole purpose of providing the service: rendering your design onto the models and generating the exports you request. Mocka3D claims no ownership over User Content.
You represent and warrant that you own the rights to all content you upload, or have the necessary authorization to use it. Uploading or generating content that does any of the following is prohibited:
The App, its code, the 3D models, the interface, the "Mocka3D" brand and the pre-made design gallery are owned by Mocka3D or its licensors, and are protected by intellectual property laws.
Designs in the pre-made gallery may be used to generate mockups within the App. Reselling or redistributing them as standalone assets is not permitted.
Mocka3D Pro is an optional paid subscription. Billing is processed through the Apple App Store or Google Play, depending on the download platform.
The subscription renews automatically at the end of each period unless cancelled at least 24 hours before the renewal date. Management and cancellation are handled from the account settings of the corresponding store.
Payments are processed by Apple, Google and the subscription management provider; Mocka3D does not store card data. Refund requests are governed by the policies of the store where the purchase was made.
Mockups generated by Mocka3D are approximate visual representations intended for preview purposes. The colors, proportions, highlights and finishes shown on screen may differ from the final physical sublimated product.
These differences may stem from screen calibration, materials, inks, printers and sublimation conditions. Mocka3D does not guarantee an exact match between the mockup and the production result, nor is it responsible for that result.
The App is provided "as is" and "as available", without warranties of uninterrupted or error-free operation.
To the maximum extent permitted by applicable law, Mocka3D shall not be liable for indirect, incidental or consequential damages, including loss of profits, data or business opportunities, arising from the use of or inability to use the App.
Mocka3D may suspend or terminate the access of any user who breaches these terms. You may stop using the App and delete your account at any time from the App settings.
Mocka3D may update these terms at any time. Material changes will be communicated within the App or through the available contact channels.
These terms are governed by the applicable law of the place where Mocka3D operates. Any dispute shall be submitted to the competent courts of that jurisdiction.
